General Terms and Conditions of Spark Europe GmbH
These General Terms and Conditions (“GTC”) of Spark Europe GmbH (“SPARK”) apply to all premises (“Premises”) and other services (“Services”) provided by SPARK. The GTC shall apply as of January 1, 2022, and may be amended by SPARK at any time. The present version has been adapted as of May 1, 2023, and is valid as of this date. A version in English is also provided, but only the present German language version is legally valid and applies in case of contradictions.
The GTC are to be understood in connection with a contract and offer agreed between a customer of SPARK (“Customer”) and SPARK. They cover the following premises and services of SPARK:
– Event & Broadcast (Meeting & Collaboration Spaces, Event Spaces, Virtual Production and Content Creation Studios, Broadcast Event Spaces)
– Office (Private Offices, Team Suites, Corporate Residences, Meeting & Event Spaces, Collaboration Spaces, Business Club, IT Services, Virtual Office)
The GTC are divided into two sections, the short-term rental (part 1) and the long-term rental (part 2). Short-term rental includes the rental and use of space for a few hours or days (e.g., Event & Broadcast Spaces, Meeting & Collaboration Spaces, etc.) and long-term rental includes the rental and use of space for at least one month (e.g., Private Offices, Team Suites, etc.). Part 1 does not apply to Long Term Rental and Part 2 does not apply to Short Term Rental. For Part 1 and Part 2, the final provisions listed at the end of the GTC apply in each case.
If other contents have been determined in the contract between a Customer and SPARK, certain clauses of these GTC shall be modified or rendered null and void. The respective clauses of these GTC shall then cease to apply and the continuing and legally binding contract shall become valid.
